over the fiscal cliff. that's one of the top stories this noontime. good afternoon. i'm david stevenson. >>> we begin with developing news at this hour. san jose police are investigating the city's 46th homicide of the year. it happened at an apartment complex on lewis road off monterey highway and janine de la vega joins us from the scene. janine, we understand police may no who may be responsible -- may know who may be responsible. >> reporter: that's right. they have two adult males detained and they are questioning them and treating them as persons of interests. homicide detectives are here at the sulker breeze apartments. all of the activities seem to be centered around a parking garage. just before 9:30 this morning, they received a 911 call that a man with a gun was at the -- on the grounds. when police arrived, they found a manner in a car shot. paramedics tried to revive him. but he died on the scene. after talking to a couple of witnesses they've determined some sort of confrontation occurred with the victim and two other men. >> what happened exactly, we don't know.

"if its a couple of days, i think ultimately it would be a blip on the radar, but if it goes two weeks, it becomes a much greater problem." a key sticking point involves a fee longshoremen receive for each container that arrives in port. the container royalty fee was invented to help offset the need for fewer workers during the transition from bulk cargo to containers in the 1950s and 60s. shippers want the fee limited. longshoremen disagree. "it can be $15,000 per person. $200 million a year added to the cost of goods. that's a very significant number." if there's no compromise, a strike could leave goods headed for ports from boston to houston at sea and retailers with a headache. "if you have a container ship delayed two weeks, do you divert it to the west coast? that's an expensive option." and presidential intervention - unlikely. over the fiscal cliff unless congress and the white house can work out a last minute deal. if there is no new budget deal by midnight tonight east coast time income tax rates will go up for all americans. coming up at 5:15 the two men leading the last minute negotiations. >>> the chp is trying to figure out what led up to a crash that killed a motorcycle rider in concord last night. it happened just before 6:30 on kicker pass road. the chp says no other cars were involved and it's unclear why the driver lost control. >>> three people are recovering after a crash after a car crashed into a concord funeral home. it happened yesterday afternoon at the we met brothers concord funeral chop ill on clayton road. it appears two teens were racing when they lost control and crashed their car into the building. the teens were taken to the hospital with serious injuries. a 66-year-old man who was inside the building has a broken leg. police interviewed a second driver that may have been racing the teens but have no arrests yet. >>> police officers are out there watching for drivers that may be cel

same time as the fiscal cliff impasse it's a potentially devastating one-two punch for the economy. neither the longshoreman's union or alliance representing the shipping companies could give us anyone to speak on camera but they say it boils down to one issue. the key sticking point is over the large containers and the payments they get for them. the shipping companies pay royalties for the containers based on their weight but the shipping companies now want to freeze the royalty payments for current longshoremen and eliminate them completely for future highers. >> they say those royalties are designed to make up for jobs lost to automation. a strike would only effect ports that handle containers and not others like automobiles. but if the shipping companies lockout the longshoremen. >> that would impact more than just containers. that would impact all cargoes at ports so that would have a much more impactful reaction. >> that was brian todd reporting. from one labor dispute to others. it caused a crab shortage across the state but things may be looking up for bay area seafood lovers. loca
